1. Introduction

Welcome to Smart Fleet. These Terms and Conditions govern access to and use of the Smart Fleet web system and/or mobile application (hereinafter, the "Platform"), owned by Strappberry LLC, contact email soporte@smartfleetapp.com.

By accessing, registering for, or using the Platform, you (hereinafter, the "User") fully and unreservedly accept these Terms and Conditions. If you do not agree with them, we recommend that you do not use the service.

2. Purpose of the Platform

Smart Fleet is a platform designed to help vehicle owners centrally monitor maintenance, income, expenses, pending payments, and other operational aspects related to their vehicle, especially when used on mobility platforms such as Uber, Didi, and others.

3. User Registration

To use the Platform, the User must:

Provide truthful, complete, and up-to-date information
Create an account using email and password (or social sign-in if enabled)

Important: The User is responsible for maintaining the confidentiality of their access credentials. Smart Fleet is not responsible for unauthorized use of an account.

4. Permitted Use

The User agrees to use the Platform solely for legitimate personal or professional purposes related to managing their vehicle(s).

4.1 Prohibited Conduct

The following is strictly prohibited:

Using the platform for unlawful or unauthorized purposes
Attempting to access, alter, or damage any part of the system, data, or services
Distributing malicious software or interfering with the normal operation of the Platform
Sharing false, misleading, or fraudulent information

4.2 Account Suspension

Smart Fleet reserves the right to suspend or cancel an account that engages in inappropriate conduct or conduct contrary to these terms.

5. Intellectual Property

All rights to Smart Fleet's software, design, logos, visual content, structure, and functionality belong to its developers
Use of the Platform does not at any time imply the transfer of intellectual property rights to the User
Reproduction, distribution, modification, or commercial exploitation of any part of the system without written authorization is strictly prohibited

6. User-Provided Content

By registering information on the Platform (income, expenses, vehicle data, notes, etc.), the User:

Retains ownership of such data
Grants Smart Fleet a limited license to process, analyze, and display such information in the context of the Platform's operation

7. Service Availability

Smart Fleet strives to offer continuous, quality service
It does not guarantee that the Platform will be free of interruptions, errors, or technical failures
Periodic maintenance and updates will be performed that could temporarily affect the system's availability

8. Limitation of Liability

Smart Fleet will not be liable for:

Damages arising from misuse of the system
Financial losses resulting from decisions made based on information shown on the platform
Technical failures beyond its control (such as internet outages or third-party server disruptions)
Incorrect information provided by the User

Note: Use of the Platform is at the User's own risk and responsibility.

9. Term and Cancellation

Use of the Platform is for an indefinite term
The User may cancel their account at any time
Smart Fleet may terminate an account for breach of these terms
In either case, the User may request the deletion of their data, in accordance with the Privacy Notice

10. Changes to the Terms and Conditions

Smart Fleet may modify these Terms and Conditions at any time
Updates will be posted on the website, and registered users will be notified
Continued use of the system after such changes will be considered tacit acceptance of them

11. Jurisdiction and Applicable Law

For the interpretation and enforcement of these Terms and Conditions, both parties submit to the laws applicable in the United Mexican States, expressly waiving any other jurisdiction that might correspond to them by reason of their present or future domicile.

This document constitutes a legal agreement between the User and Smart Fleet. We recommend reading it in full before using the Platform.
